For two nights (November 20 & 21, 2021) my wife and I stayed at the Comfort Inn and Suites, Hamburg, NY. We booked a non-smoking room through Orbitz in May 2021.
Approximately 2 to 2 ½ hours after checkout, we were heading home to Pennsylvania when the hotel called me. The person on the phone told me that he was charging our credit card for $250 because we smoked in our room. My wife and I immediately got upset and told him that we are non-smokers, and that was impossible. He said there were ashes on the windowsill, in the bathroom sink, and a cigarette butt in the toilet. This is an outright lie. We had no visitors either. We even asked if he was mistaken and had the wrong room. He said, “No, room 227”, which was our room. We asked for the manager, and he said he was the manager. We then asked for his name, and he gave us a fake last name (as we later learned from corporate)! After some back and forth with him, he hung up on us. My wife then proceeded to contact their corporate office and filed a complaint. They told her that they would turn it over to their investigative team and get back to us. After weeks of not hearing from corporate we called them. They said that unfortunately, each hotel is independently operated and there is nothing they can do. The decision is ultimately up to the manager. So, they end up policing themselves!
We also contacted our credit card company to file a complaint on the charge. Per their policy, I had to provide documentation and a full explanation of the event. They then turned it over to their fraud department and put a temporary hold on my card for the $250. They gave the hotel the opportunity to dispute my claim, which they did. Now I am stuck with a bogus charge and there is nothing I can do.
I know management will likely see this and say that what I wrote above is not accurate. It is a case of "he said, she said", but all I can tell you is that I am a non-smoker and am now paying $250 for smoking in my room. I would highly recommend that if you are foolish enough to stay here, have a manager check your room before leaving and have him sign off that your room was ok.
